General Warranty Terms of the TICAB Company Warranty Terms Recognition of warranty claims is conditional upon the use and installation of the products in accordance with the applicable TICAB general operating and installation instructions, as well as TICAB recommendations or directives, or in accordance with a design approved by TICAB . Warranty service is provided upon presentation of a properly completed warranty certificate for the installed model. Otherwise, warranty claims will not be accepted. TICAB’s Warranty Obligations During the warranty period, TICAB undertakes to repair or replace defective components of the supplied product which, despite proper handling supported by documentary evidence and compliance with the applicable installation and operating instructions, including certificates for the materials used during operation, has become completely or substantially unusable due to defects in original components or improper manufacturing. The warranty covers the replacement of spare parts and assemblies during the limited warranty period, excluding the cost of cleaning, dismantling, labour and transportation. TICAB undertakes to provide service as quickly as reasonably possible, either directly or through an authorised representative. The customer shall be informed of and shall agree with the service department on the expected date of delivery of the machine. Replaced defective parts and components shall not be returned to the customer. Any statutory claims made against TICAB or its authorised representatives, including authorised installers, for compensation for any additional losses are excluded. This includes, without limitation: repair costs; dismantling and reinstallation costs; transportation costs; damage caused to third parties; materials that are not part of the defective product. Modifications introduced after receipt of the order and subsequently applied to all supplied equipment of the relevant model, even where they result in a formal difference between the supplied product and the ordered product, do not create a right to warranty service. The warranty applies to all components included in the scope of supply whose identification number is stated in the PRODUCT MANUAL for the relevant product, as well as to all components listed in the “Additional Components” section of this warranty certificate. The warranty does not cover parts and assemblies subject to rapid or natural wear, including but not limited to: glow plugs; incandescent lamps; thermal fuses and fuse links; brushes; fuel filters; air-dryer filters; oil seals; gaskets; all rubber and rubber-based components forming part of individual assemblies or the equipment as a whole; other parts specifically identified as wear parts in the operating instructions for the relevant machine. The warranty also does not cover damage caused by improper handling, including the use of fuel or operating materials that are not suitable for the relevant type of machine. Warranty Exclusions The warranty shall become void if the product configuration has been altered through the installation of non-original parts or components, or if the applicable installation and operating instructions have not been followed. A warranty claim may not be accepted where the possibility of satisfying that claim has been materially limited as a result of improper handling or modifications made to the product, including the removal of particular parts or components. The warranty does not apply to products installed or serviced by unauthorised service centres. Products purchased outside the TICAB dealer network are also not eligible for warranty repair. Warranty obligations will be performed only upon presentation of a properly completed TICAB product manual or product passport. The warranty does not cover preventive work or routine maintenance. If the product manual or passport is lost, no duplicate will be issued. TICAB shall not be liable for any change in the condition or operating performance of the product resulting from: improper storage; extreme climatic conditions; other external influences exceeding the permissible operating ranges specified in the technical documentation for the relevant machine. Any terms or reservations concerning warranty obligations that are inconsistent with the current TICAB Warranty Terms or the General Terms and Conditions of Sale and Delivery shall be invalid, regardless of who established them, when they were established, or in what form they were made. Warranty claims will be accepted only if they are submitted in writing immediately after discovery of the defect and include a clear and detailed description of the defect. Repair or replacement of the product shall not constitute grounds for: extension or renewal of the original warranty period; replacement of the entire machine; refund of the purchase price. The warranty period does not cover defects existing at zero operating hours or before initial use. Claims concerning such defects must therefore be submitted before the product is put into operation. Submission of a Warranty Claim To submit a warranty claim properly and in accordance with the above provisions, the warranty claim form must be completed. Claims relating to discovered defects must be submitted no later than 10 days after discovery of the defect. Continued operation of the machine with unresolved faults is not permitted. The following documents and materials are required to submit a claim: A completed product manual or product passport. A copy of the invoice for the product and/or installation services. A detailed description of the problem, including photographs and video recordings. After the machine or component is submitted to TICAB , a complete diagnostic inspection will be carried out to determine the causes of the reported malfunctions. The diagnostic results may lead to one of the following outcomes: Defective component identified If a defect is confirmed, TICAB undertakes to replace the defective component as quickly as reasonably possible. Replacement will be carried out only after TICAB has received the defective component. TICAB will cover the transportation cost of the defective component, provided that the method of transportation has been agreed with TICAB in advance. Warranty case confirmed If the diagnostic results confirm that the case is covered by the warranty, TICAB undertakes to repair the product as quickly as reasonably possible. Where spare parts are replaced or repair work is performed, a warranty period of up to 90 days from the date of repair shall apply, but this period shall not extend beyond the original overall warranty period. If the original product warranty expires earlier, the warranty shall apply only to the replaced spare parts. Non-warranty case If the diagnostic results show that the case is not covered by the warranty—for example, because the warranty period has expired, installation requirements have been violated, operating conditions have not been observed, or other warranty conditions have not been met—the customer will be offered a paid repair and an estimated repair cost. For paid repairs performed by an authorised TICAB service centre, the warranty on replaced parts and repair work shall be 6 months from the date of repair.
